Article 1: Application of the General Terms and Conditions of Sale
The brand "Grain de Sail®" and its commercial site defined below are the property of the company Grain de Sail SAS, hereinafter referred to as "the company", whose head office is located at 4, route du bas de la rivière, 29600 MORLAIX (SIREN : 538 866 740).
These general terms and conditions govern the relations between the website https://www.graindesail.com hereinafter referred to as "the website" and the Internet user making a purchase on the site.
The customer just has to click on "General Terms and Conditions of Sale" (hereinafter referred to as « T & Cs) to know the terms and conditions of his order, even before he has started the ordering process.
Placing an order implies the buyer's full and unreserved acceptance of these T & Cs, to the exclusion of all other documents such as prospectuses, catalogues issued by the seller and which have only an informative value.
The T & Cs can be modified at any time, provided that these modifications appear on the site.
Article 2: The order
Your order is validated after having completed the dedicated form and then paid the amount of the order by one of the means of payment provided for this purpose. Make sure you have correctly entered your name, first name, address and phone number. The sale is final after the validation of payment. A confirmation e-mail is then sent to you and your order is registered. You can access your order at any time by identifying yourself on the site.
The validation of your order is worth signature and express acceptance of all the operations carried out on the site. Your personal information provided during the order is binding. In the event of an error, we cannot be held responsible for the inability to deliver the order.
We will inform you of the availability of products during your order. If, despite our precautions, certain products are temporarily unavailable after your order (out of stock), you will be promptly notified by email.
Our company reserves the right to cancel or refuse any order from a buyer with whom there is a dispute relating to the payment of a previous order.
In addition, in order to control as much as possible the conditions of transport of our chocolates, we reserve the right to postpone deliveries if the temperatures of the moment are considered incompatible with the good conservation of our products.

Article 3: The price
The prices of the products are indicated in euros (€) and include the costs of handling, packaging and conservation of the products. The price also includes the VAT and any applicable French laws on the date of the order, for any order delivered in mainland France.
The amounts visible on the site therefore correspond to an amount including tax but excluding shipping costs.
Article 4: Invoicing
A detailed invoice will accompany the delivery of your package. Invoices are issued in euros (€), with, if applicable, an indication of the equivalent in the customer's local currency.
All bank payments are made in euros (€).
Article 5: Shipping costs
The shipping costs vary based on weight and location of the delivery. These costs include shipping as well as the packaging (in particular thermal protection for chocolates). Outside of specified and contrary indications, the company offers one or more carriers to choose from when ordering from the site. The transport will be offered at no charge for orders of 49€ or higher (including VAT) only to pick-up/relay points.
In the case of deliveries to pick-up/relay points where the packages have not been collected in time, the re-shipment of the goods will be invoiced to the customer (by check or bank transfer).
Article 6: Payment
The price of the items ordered is payable in full to the company by secure electronic payment. That means by using a payment card or by using bank transfer.
The payment cards accepted to date are: CB, VISA and MASTERCARD.
For each order a debit request from your bank account will be sent to your bank within 24 hours.
It is your own responsibility to save and print your payment certificate if you wish to keep the bank details relating to the transaction.
You warrant that you are fully authorized to use the payment card for the payment of your order and that your means of payment provide access to sufficient funds to cover all costs resulting from the use of the services of the company.
Article 7: Refund transaction
In the event of a delivery that does not comply with the order transmitted or for other commercial reasons, we may decide to reimburse your order in full or in part. The reimbursement is made by check.
Article 8: Delivery
The parcels are generally shipped within 2 working days after receiving the payment. They are shipped with a tracking number and delivered without a signature.
Shipping costs include preparation and packaging costs as well as postage. The preparation costs are fixed, while the transport costs may vary according to the total weight of the package. We recommend that you consolidate all your items into one order. We cannot combine two orders placed separately and shipping charges shall apply to each of them.
We are committed to paying attention that your parcel arrives without any risk of loss or damage at your location. Furthermore, we pay the highest attention to fragile items. However, if you wish to entrust the delivery of your package to a carrier other than those we make available, Grain de Sail cannot under any circumstances be held responsible for the loss or damage to your package after we will have given it to the carrier of your choosing.
The dimensions of the boxes are appropriate and your items are properly protected.
Depending on the carriers available on the site, the products will be shipped to a pick-up/relay point or to the delivery address indicated on the order form. In case you want to ship your package to another address, just tick the box « different shipment address » and fill in the address of the receiver.

Article 10: withdrawal period
You have the right to withdraw from this contract without giving any reason within fourteen (14) calendar days, in accordance with the provisions of Article L221-18 of the Consumer Code.
The withdrawal period expires fourteen (14) days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of the withdrawal form or an unambiguous declaration, either:

In accordance with the provisions of Article L221-23 of the Consumer Code, you must return the item without undue delay and, in any event, no later than fourteen (14) days after you have communicated your decision to withdrawal of this contract. This period is deemed to have been met if you return the goods before the expiration of the fourteen-day-period.
You are responsible to handle the charges of returning the products. The transport of the returned products is also your responsibility.
In the event that the product, due to its nature (bulky and / or heavy or of high value), cannot be supported by La Poste (the French post), you can use the service of a carrier of your choice.
The estimated cost of returning the product indicated in the table below is presented for information only and is not contractually-binding for the company. The costs remain at your expense.
The costs to be paid for returning the product will be established according to the carrier you choose and according to the following criteria:
- The type of the product
- Its weight and dimensions
- The distance to be covered
- The speed of the delivery
The prices below are therefore given only as an indication:

· between 2KG and 4 KG --> from 8€ to 12€
· between 4KG and 10 KG --> from 10€ to 15€

The products affected by this return may be the subject of an exchange or a refund. The product must be returned in perfect condition, in its original packaging intact. It must be accompanied by all its accessories (documentation, samples and other commercial offers) initially inserted in the original package.
If you wish to be reimbursed, we will send you a check corresponding to the price of the products within a period of less than or equal to 30 days following the sending of the electronic mail or the registered letter with acknowledgment of receipt or of the returned products.
In the event of partial cancellation of an order, the company will retain the benefit of the shipping costs corresponding to the product(s) delivered.

The company cannot be held responsible for the non-performance or delay in the performance of the contract concluded with the purchaser, in the event of force majeure.
